Regulatory scope and governance
We advise clients on core obligations under these regimes, including requirements relating to safeguarding of funds, conduct of business rules and governance arrangements. The firm has dedicated experts in advising on the negative scope of regulation, including exclusions under the payments and e-money frameworks and consumer credit legislation. This includes the UK and EU Limited Network Exclusion, the Electronic Communications Exclusion, the Technical Service Provider Exclusion and other relevant safe harbours that may be available in other jurisdictions.
Multi-jurisdictional regulatory advice
Through our well-established relationships with local law firms globally, we also provide multi-jurisdictional regulatory advice across a wide range of markets. Our objective is to help clients develop and implement regulatory policies on a consistent global basis, minimising operational variation wherever possible.
Commercial agreements
We also support clients by drafting and negotiating key commercial agreements, both with third parties and within group structures, including outsourcing arrangements. We prepare framework contracts for payment and related services to ensure alignment with applicable regulatory and conduct requirements.
